We have a new product in our BINARYTEC family. The humanify time recording system. But before we go into the great functions of our new software, we would like to give you a few legal aspects of time recording. Because what many people don't even know: Since 13 September 2022, employers have been legally obliged to record their employees' working hours!  

This is according to the decision of the Federal Labour Court of 13.09.2022: Employers are obliged under Section 3 (2) No. 1 of the Occupational Health and Safety Act to introduce a corresponding system.

No, there is no transition period.

What requirements do I have to fulfil as an employer?

It is not enough to simply provide a system - as an employer, you are obliged to ensure that this system is actually used and utilised.

What requirements must a time recording system fulfil?

The law states that an "objective, reliable and accessible system" must be used. Of course, this leaves a lot of room for manoeuvre 😉 To be on the safe side, we recommend paying attention to the following points:
a. It should be possible to store the time recording for at least 2 years
b. It should be easy to use and easily accessible for all employees
c. Online access is available for employees who work from home
d. Break times should be recorded
e. To save resources, it also makes sense to use the time recording system to record absences such as holidays and sick days

What happens if I don't use a system?

The competent occupational health and safety authority does not have to impose a fine immediately, but can impose a fine of up to €30,000 if an offence is detected.

What is the purpose of the obligation to record working hours?

Primarily to protect the health and safety of your employees. The purpose of recording working hours is to ensure that the maximum daily working hours and rest periods are complied with.

Now the most important thing: We supply you with the necessary hardware to go with the comprehensive software. For on-site time recording, you need a time recording terminal, RFID tags such as employee cards or key fobs, as well as a reader or writer for the RFID tags mentioned.
